Terms and conditions: Effective January 1, 2025

By creating an account and using Firestarter Marketing, you agree to comply with these Terms and Conditions and all applicable laws. If you do not agree, please do not use our services.

Firestarter Marketing provides an online platform for local marketing management, which includes:

• Social media post creation
• Marketing ad generation and deployment
• Email and SMS deployment
• Search Engine Optimization monitoring and suggestions
• Content creation and storage
• Digital Marketing and planning

This Agreement governs your use of all features and services provided by Firestarter Marketing.

You must be at least 18 years old and a valid representative of the business you register to use our services. By accepting these terms, you confirm that you meet these criteria.

• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Data Input: You agree to provide accurate, complete, and lawful information in connection with the use of the software.
• Compliance: You are responsible for ensuring your marketing efforts comply with applicable laws, including advertising, intellectual property, and data privacy laws.
• Social Media Compliance: You are responsible for maintaining the compliance to standards of the applications where you are posting.

We grant you a limited, non-exclusive, non-transferable license to access and use Firestarter Marketing solely for managing your business's marketing activities. Any unauthorized use of the software is strictly prohibited.

• User Content: You retain ownership of any content you create or upload to Firestarter Marketing. By using the platform, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of operating the service.
• Software Rights: All software, code, and technology related to Firestarter Marketing are owned by Firestarter Labs. You agree not to copy, modify, or distribute any part of our software without our written consent.

• Fees: Fees for using Firestarter Marketing will be displayed on our website or provided through your account dashboard. By subscribing, you agree to pay all applicable fees.
• Renewals and Cancellations: Subscriptions will renew automatically unless canceled. You can cancel at any time, but refunds may not be provided for partial billing cycles.

• You may not use Firestarter Marketing to upload any unlawful, harmful, or offensive material.
• You may not use Firestarter Marketing for any unlawful purpose. 
• You may not reverse engineer or otherwise interfere with the operation of our software.
• You may not attempt to access restricted parts of our system or use the platform to store or process data not related to your marketing activities.

Firestarter Marketing is provided "as-is" without warranties of any kind. We do not guarantee the accuracy, reliability, or completeness of our services and disclaim any implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.

You agree to indemnify, defend, and hold harmless Firestarter Labs, its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of your use of Firestarter Marketing or violation of this Agreement.

In no event shall Firestarter Labs or its affiliates be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, arising out of your use of Firestarter Marketing. Our total liability shall not exceed the fees you paid us within the twelve (12) months prior to the event giving rise to the liability.

We reserve the right to terminate or suspend your account at our discretion if we believe you have violated this Agreement or any applicable law. Upon termination, your right to use Firestarter Marketing will immediately cease, but provisions relating to liability limitations, indemnification, and intellectual property will survive termination.
